With the rapid development of the Bakken reserves in North Dakota, increased production from shale formations throughout the United States, dramatic development of Canadian oil sands, and continuing lack of adequate infrastructure to move oil and gas from the production areas to the market areas, shipping of oil and gas is taking new directions, and an understanding of the regulatory regimes governing the shipping of these products by pipeline and by rail is critical.

This course reviews current federal regulation and important/trending state regulation for transportation by pipe and rail. It addresses the changing market dynamics and the impacts on oil and gas shipping in the U.S. with respect to pricing, rates, contracting, and scheduling.

Join Elisabeth Myers, an experienced oil and gas regulatory lawyer, litigator, and adjunct law professor, and Barclay Nicholson, a partner with Norton Rose Fulbright in Houston, who is known for his nationwide litigation practice which focuses on oil and gas and commercial disputes, as they address the latest developments and trends impacting the shipping of crude oil, petroleum products, and natural gas in the U.S.

Elisabeth R. Myers/Principal/Myers Energy International
Elisabeth R. Myers has practiced energy law for more than 20 years and is the founding principal of Myers Energy International, an independent energy consulting, law and policy practice.

Elisabeth represents businesses and stakeholders in the oil and gas industry. Her clients have included the major oil companies, such as ExxonMobil and BP, as well as independent producers and marketers of oil, natural gas, and natural gas liquids, and government regulatory bodies. Elisabeth has successfully litigated numerous administrative cases before the Federal Energy Regulatory Commission, the California Public Utilities Commission, the U.S. Courts of Appeals, and the United States Supreme Court.

A frequent speaker and lecturer, Elisabeth also consults, advises, and provides training on various regulatory and related transactional matters, and advises companies on pipeline safety compliance issues under the U.S. Department of Transportation's Pipeline and Hazardous Materials and Safety Administration regulations.

Elisabeth is an Adjunct Associate Professor teaching the “Regulation of Energy” course at the Washington College of Law at American University in Washington, D.C. She is also a member of the faculty for Lawline.com and an on-call subject matter expert for both the Gerson Lehman Group and ExpertConnect.

Barclay Nicholson/Partner/Norton Rose Fulbright
Barclay Nicholson is a Partner at Norton Rose Fulbright and has significant experience in handling energy-related litigation and construction litigation cases and has represented some of the world's major oil and gas producing and refining companies. Barclay serves on the firm's Shale and Hydraulic Fracturing (Fracking) Task Force and recently has authored a number of articles and given several speeches across the nation on fracking.

Barclay has handled commercial cases that involve amounts exceeding one billion dollars. He has represented clients in numerous proceedings both in the United States (in federal and state courts) and abroad (in the LCIA, ICC, UNCITRAL and ICDR). Additionally, he has represented clients before various administrative and congressional oversight boards.

Prior to joining the firm, Barclay served as Briefing Attorney for Justice Alberto Gonzales of the Texas Supreme Court, who later served as the United States Attorney General. Barclay also served as Briefing Clerk for Chief Justice Thomas R. Phillips of the Texas Supreme Court.

James Cargas/Senior Assistant City Attorney/City of Houston/Candidate for Texas Congressional District 7
James Cargas is currently a candidate for Texas Congressional District 7 and a Senior Assistant City Attorney for the City of Houston. James advises clients on all energy matters including procurement of power, natural gas and fuel. He coordinates complex environmental litigation and handles an assortment of transactional matters.

James is a former member of the Clinton Administration and a former Special Assistant (Schedule C Political Appointee) for the U.S. Department of Energy, Office of Fossil Energy.
