This comprehensive 2-day seminar offers a multi-perspective look at EU, German and US export controls - including upcoming changes and reforms - and gives practical advice that will help your company capitalize on new opportunities while avoiding costly export violations.

Export control laws create significant legal and business issues for companies actively engaged in international trade. In fact, many companies now require that potential business partners demonstrate an effective commitment to complying with EU, German and US export controls and sanctions, because the world’s leading companies all understand that complying with the complex export control laws is a critical element of ensuring an efficient supply chain and providing top-notch customer service and support.

The United States Government has demonstrated its willingness to apply its rules to companies and activities outside the US, banning certain companies from doing business directly or indirectly with the US, and with US companies, and imposing multimillion dollar fines on others. And, of course, the civil and criminal legal implications of violating German and EU export controls apply directly to German organizations, including executive management and other employees.

However, government export control rules are constantly changing and evolving. New German export control laws enter into force on 1 September 2013 and US export control reform is moving many military items from the US Munitions List to the Commerce Control List, which traditionally has controlled only commercial and dual-use items. The rules change, the times change and your business changes. If you are not up to date with the new rules, you may find out you are complying with rules that no longer exist.

SEMINAR INSTRUCTORS:

Stephan Müller is a partner at Oppenhoff & Partner. Before joining Oppenhoff & Partner in 2008, Mr. Müller was a partner at Linklaters LLP since 2001. He specializes in public law with Export Control forming a major part of his practice. Stephan advises national and international corporations on all national, EU and US law related compliance and permitting issues, including representation before courts and in administrative proceedings. He lectures on export control law at the University of Applied Sciences, Cologne. Mr. Müller speaks at national and international conferences and has published articles on many aspects of export controls. The JUVE handbook on German commercial law firms has identified him as a “leading name” in his field of expertise for many years now.

John R. Black is a Principal of BSG Consulting and has been involved in US export and trade control matters since 1984. He advises US and foreign companies, law firms and governments on US export, and has earned a reputation as one of the leading experts in the field. From 1984–88 he worked for the US Commerce Department, where he wrote the Export Administration Regulations (EAR) and interpreted it for government and industry. He uses his comprehensive knowledge of the US rules that impact military and commercial companies to help his clients stay in compliance without missing legitimate business opportunities. He has been a featured speaker at over 100 conferences around the world and has written numerous articles and several books on the subject. Mr. Black is an accredited Export Compliance Professional (ECoP ® ) on both the EAR and the ITAR.

STEPHAN MORWEISER studied law in Heidelberg. After completion of the mandatory practical training (Referendariat) in 1992 he became a judge at the district court in Mannheim. At that time he was handling civil law suits. In 1994 he moved on to the State prosecution office in Mannheim where he specializied in the prosecution of business crimes. Since 2005 he has been the State Prosecutor at the Federal Prosecutor´s Office (Bundesanwaltschaft) in Karlsruhe. In addition, he is a lecturer at the Customs Criminal Investigation Office and is a licensed US customs broker.

AXEL JUNSKI is an attorney at law. Since 2012 he has been employed in the Export Control Department of Fraunhofer-Gesellschaft. Fraunhofer Gesellschaft is Europe´s largest private research institution, with more than 22,000 employees and research activities in many different areas -- from green energy to military projects. Prior to his involvement at Fraunhofer, Axel was an attorney for more than 6 years in private practice in Dubai and Abu Dhabi. During that time he specialized in advising German companies on their business activities in the region.
